Railbiking in Greece OE is a company that offers cycling tours with touristic railbikes in Greece. Our company is registered with the General Commercial Registry (G.E.MI.) and complies with all necessary safety regulations.

We are also holders of an operating license issued by the Hellenic Railways Organization (OSE) and GAIOSE, which allows us to operate on a specific section of the disused railway in Megara. This license ensures that our tours are safe and comply with all regulations for the use of railway lines.

The website rail-biking.com and the services provided therein are offered on the condition that you accept the terms of use that follow and the data protection policies, which are accessible on the homepage of our website. By visiting our website, you declare that you have read and understood the above terms of use and agree to abide by them. If you do not agree to these terms, you are not allowed to access our website and use our services.

By using our website and accepting our services, you confirm that you are over 18 years of age. If you are under the age of 18 but at least 13 years old, you may use our website only under the supervision of a parent or other adult who has legal custody and who agrees to abide by these terms of use. If you are a parent or legal guardian of a person aged between 13 and 18, you are fully responsible for your child's use of the website, including all financial liabilities and legal obligations.

We reserve the right to modify these Terms of Use at our discretion and whenever we deem it necessary. Such modifications shall be effective from the date of their publication on the Internet.

DEFINITIONS

For these Terms of Use, the following definitions apply:

"Tour" - refers to the organized bicycle tour on train tracks using special bicycles called railbikes, which are hosted on our Website.

"Agreement" - These Terms of Use and the Privacy Policy are available on the homepage of our Website.

"Contract" - Any contractual relationship entered into between You concerning the reservation of your participation in the Tours.

"Services" - The provision of information through our Website regarding the Tours and the provision of electronic tools to book your participation in the Tours.

"We" "Company" - Our company with the trade name "Railbiking in Greece OE" 

"Website" - The website is accessible through the domain name rail-biking.com, including all pages thereof.

"You" - Any user of the rail-biking.com Website who visits our Website and/or receives our services.

BOOKINGS

Before booking It is your responsibility to inform us of any medical conditions or physical disabilities within your group that necessitate to review of the participation or special treatment or attention. 

In a booking involving multiple passengers, the 'lead passenger' will be considered as having agreed to the terms and conditions on behalf of all passengers within the booking. The 'lead passenger' is the individual who initiates the booking for all passengers in a multi-passenger reservation.

Once you complete the booking, you will receive a confirmation email with all relevant information. Check your spam box or contact us if you have not received a confirmation email with a PDF file of your ticket within 10 minutes after the online booking. 

CANCELLATIONS & RESCHEDULING

Communication 

• We will communicate with you via email in case of tour cancellations or delays.

• Please ensure that you have provided a valid email address and phone number to avoid missing important updates.
  
• The Company is not responsible for the loss of important updates due to incorrect or incomplete contact information provided by the user of the website during booking.

Operator Cancellations 

The Operator reserves the right to modify, amend, or cancel any trip as necessary due to weather conditions, booking system errors, staff sickness, requirements from OSE (Hellenic Railway Organization) to pause railbiking for maintenance, or due to termination of the contract.

Intoxication / Drug Use 

Our company retains the right to reject your booking if it poses a safety risk. Participants who present themselves for a trip while intoxicated or under the influence of drugs will not be allowed to participate and will not receive a refund.

Cancelations due to weather:

• Tours operate in light rain if deemed safe.
  
• Participants may cancel due to forecasted light rain up to 12 hours in advance via email. Official forecasts from the Hellenic National Meteorological Service (HNMS) will be used for weather evaluations. emy.gr
  
• The company reserves the right to reschedule or cancel trips due to adverse weather conditions. In such cases, full refunds or transfers to other trips will be issued.

Cancellations by participant

• All cancellation requests must be submitted via email to railbiking@gmail.com
• To receive a refund for individual bookings, cancellations must be made via email at least 3 days before the departure of your trip. A cancellation fee of 10% will apply.
• For groups of 6 people or more, cancellations require 7 days notice to be eligible for a refund.
• Cancellations made within 3 days of departure for any reservation or no-shows are non-refundable.

Rescheduling

• Requests for rescheduling must also be made via email at railbiking@gmail.com
• Changes made 3 days or more in advance are free of charge.
• A 30% fee applies to second requests or those submitted within 3 days of departure.
• Groups of 6 or more participants require 7 days advance notice for rescheduling to avoid charges.
• Rescheduling on the day of the Tour is not permitted.

*As a courtesy, riders who cancel, arrive late, or no-shows on the day of the reservation can rebook at a 15% discount. 

Refund Policy

If a refund is owed, refunds will be processed within 5-10 working days.

PAYMENTS, PRICES, COUPONS, AND GIFT CARDS

Our company does not collect credit card data. Payments are processed through the Stripe payment system

Prices:

• Prices are subject to change, so please confirm the cost at the time of booking.
• Prices for private tours are fully customized.
• All prices are in euros.

Coupons

You may choose to have a coupon for a specific tour. To make a reservation using your coupon, you will need to use the relevant code. Reservations with coupons must be made within twelve months from their issue date. They are not subject to cancellation or modification to your advantage and are non-refundable. If a tour becomes unavailable, we will refund the value of your coupon.

Gift Cards

We can offer gift cards of any value you specify. Subject to the recipient's compliance with this agreement, purchasers of gift cards may offer them to the recipients of their choice. Gift cards are also in code form. To make a reservation using your gift card, you will need to use the relevant code.

If the value of the gift card is lower than the booking price for the tour you have reserved, then the recipient will need to pay the difference. On the other hand, if the gift card has a value greater than the booking fee for the tour you have booked, then the remaining balance of the gift card remains as credit in the recipient's account for future bookings.

Reservations with gift cards must be made within twelve months from their issue date. They are not subject to cancellation or modification to your advantage and are non-refundable. We are not liable in case you lose your gift card.

DISCLAIMER OF LIABILITY

Railbiking in Greece GP does not provide any warranty or condition, express, implied, or statutory, regarding its Website or Services. The Website and Services are provided "as is" and "as available".

Railbiking in Greece GP does not guarantee that the Website or Services will be uninterrupted or error-free. Services may be suspended or restricted from time to time for repairs, maintenance, or the introduction of new facilities or services.

Our Company addresses the risks associated with railroad transportation, including road crossings. You must adhere to the instructions provided by our staff at all times. Parents/guardians are accountable for supervising their minors and ensuring they comply with the directives given by our staff. 

Each participant is required to sign a paper disclaimer, which will be provided on-site before the Tour.

INTELLECTUAL PROPERTY RIGHTS

The Company holds the intellectual property rights to the content and services provided on the website.

The content of the website is protected by the laws of the European Union and international intellectual property law.

Reproduction, copying, translation, modification, distribution, public performance, public display, or any other use of the content of the website without our permission is prohibited.

Additionally, the use of graphics, logos, icons, or photos of the Company's services in combination with products or services not provided by the company in any way that may cause confusion to consumers or affect the reputation and image of the company is prohibited.

GENERAL

For any dispute between you and Railbiking in Greece GP arising out of or in connection with the use of our Website and Services, these Terms of Use shall be governed and interpreted in accordance with Greek law without reference to conflict of law principles and are subject to the exclusive jurisdiction of the competent courts of Athens, Greece.

The company shall not be liable for any failure or delay in fulfilling any obligation under these terms resulting from force majeure conditions, such as natural events (including fire, flood, earthquake, storm, hurricane, or other natural disasters), war, invasion, hostilities (whether war has been declared or not), revolution, uprising, military occupation, terrorism, government sanctions, embargo, labor dispute, strike, blockade, interruption or failure of electricity or communications, sabotage, Trojan horses, software viruses, malicious software, unauthorized access to information systems, DDoS, cracking, and other similar illegal acts by third parties. In the event of force majeure, the affected party will notify the other party and make reasonable efforts to mitigate the adverse effects of force majeure on the fulfillment of these terms. However, this provision does not exempt you from the obligation to pay for the services provided.

Any observation, claim, request, or other communication addressed to us should be sent either by certified email message, by registered letter, or by email. All observations submitted by email are considered to have been given from the day after transmission. All observations submitted by mail are considered to have been delivered 15 days after their dispatch.
